1. Acceptance of Terms
By accessing or using CryptoAPI Auto ("CPay", "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all users, including merchants, developers, and administrators.
2. Service Description
CPay provides a non-custodial cryptocurrency payment gateway that enables merchants to accept USDT and USDC payments across multiple blockchain networks including TRON (TRC20), BSC (BEP20), Ethereum (ERC20), Polygon, Solana, Arbitrum, Base, Optimism, and Avalanche. The Service includes API access, webhook notifications, dashboard analytics, and wallet management tools.
3. Account Registration
To use the Service, you must create a merchant account by providing accurate and complete information. You are responsible for maintaining the security of your account credentials, API keys, and wallet configurations. You must immediately notify us of any unauthorized access to your account. You are solely responsible for all activities that occur under your account.
4. Non-Custodial Nature
CPay is a non-custodial payment gateway. We do not hold, store, or control your cryptocurrency funds. Payments are made directly to wallet addresses configured by you. You maintain full custody and responsibility for your funds at all times. We are not liable for any loss of funds due to incorrect wallet configurations, compromised private keys, or blockchain network issues.
5. Fees and Payments
Transaction fees are charged as a percentage of each completed payment, as specified in your service plan. Withdrawal fees vary by blockchain network. Fee structures may be modified with prior notice. Fees are non-refundable. Current fee schedules are available on our Pricing page and within the merchant dashboard.
6. API Usage
API access is subject to rate limits as defined by your service plan. You must properly implement HMAC-SHA256 request signing for all API calls. Abuse of API endpoints, including excessive requests, automated scraping, or reverse engineering, may result in account suspension. API keys must be kept confidential and not shared with unauthorized parties.
7. Prohibited Activities
You may not use the Service for: illegal activities or transactions; money laundering or terrorist financing; fraud or deceptive practices; circumventing sanctions or export controls; processing payments for prohibited goods or services; attempting to exploit system vulnerabilities; any activity that violates applicable laws or regulations.
8. Service Availability
While we strive for 99.9% uptime, the Service is provided "as is" without warranties of uninterrupted availability. We may perform maintenance that temporarily affects service availability. Blockchain network congestion or outages are beyond our control and may affect transaction processing times.
9. Limitation of Liability
To the maximum extent permitted by law, CPay shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or cryptocurrency. Our total liability shall not exceed the fees paid by you in the twelve months preceding the claim.
10. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or dashboard notification at least 30 days before taking effect. Continued use of the Service after modifications constitutes acceptance of the updated Terms.
